According to FINRA BrokerCheck, Suess has a pending customer dispute involving Delaware Statutory Trust investments purchased in connection with a Section 1031 tax-deferred exchange.
The claimant alleges a lack of suitability and due diligence, breach of contract, and breach of fiduciary duty, among other claims. The reported investments were purchased in May 2022 and are classified as real estate securities.
The complaint was received in March 2026. BrokerCheck does not report a specific damages demand, but indicates that alleged damages may exceed $5,000. (FINRA)
The dispute remains pending. Its allegations have not been proven, and Suess is entitled to contest them.
