Ashley Marie Bolson, Formerly of CFD Investments, Named in Customer Dispute Alleging Fraud, Negligent Misrepresentation, and Violations of the Iowa Securities Act

INVESTORS: Former CFD Investments broker Ashley Marie Bolson is facing a customer dispute alleging fraud and non-disclosure, negligent misrepresentation, breach of fiduciary duty, negligence, breach of contract, failure to supervise, and violations of the Iowa Securities Act.

Ashley Marie Bolson (CRD#: 5368684) was registered as a broker with CFD Investments from 2016 until 2019. Previously, Bolson was registered as a broker with Oakbridge Financial Services from 2014 until 2016.

Bolson has four disclosures on her BrokerCheck report. One customer dispute filed against Bolson was denied.

Allegations: The complaint alleges several activities in relation to the sale of private placement investments that were sold away from CFD Investments, Inc. The allegations include the following: Fraud and non-disclosure, Negligent Misrepresentation, Breach of Fiduciary Duty; Negligence, Breach of Contract; Failure to Supervise/Respondeat Superior; and Violations of the Iowa Securities Act.

October 2019 Employment Separation After Allegations

Allegations: While under heightened supervision, Bolson provided inaccurate information to the firm in connectio with an internal review.

Broker Comment: My association with CFD ended on October 24, 2019, when CFD discovered a previously unknown blind copy email issue regarding a default setting on my computer. Upon subsequent investigation, I attempted to figure out what happened and corrected the issue. CFD allged that I made inaccurate statements during the internal investigation conducted by CFD. However, upon clarificatioin to CFD, I made clear that my statements were accurate because they were attempts to solve the problem, rather than to shift blame to avoid having to pay an insurance deductible on CFD’s policy. Even though the issue was recolved an no further requests were made by CFD, CFD decided to end my association with CFD via email. Thiis was done without any further discussion or communication to me, done without any further discussion or communication to me, which greatly disappointed me and was unnecessary. Contrary to what CFD wrote in my BrokerCheck report, I did not make any false or inaccurate statements, and CFD knew that after I clarified why I said what I said. But, CFD decided to end my association with them anyway, which was wrong, unfair and irrational.

Allegations: Claimant alleges breach of fiduciary duty and unsuitable investment concentration of Atlas Growth Partners.

June 2019 Customer Dispute

Status: Settled

Allegations: Claimants allege that financial adviser engaged in improper outside business activities, making unsuitable investment recommendations, fraudulent and negligent misrepresentations and omissions of material information, Fraud, Negligence, Breach of Fiduciary Duty, and Breach of Contract in with the sale of variable annuities and a private placement investment.

Damage Amount Requested: $75,000.00

Settlement Amount: $32,600.00

Broker Comment: None of the sales activity alleged in the complaint involves Ashley Vietor-Bolson. She was not the financial advisor for the claimants during any of the time in question, and instead served as an assistant to financial adviser Dana Veitor, who is also a respondent in this action. None of the variable annuities that are the subject of the complaint were sold through cfd Investments, Inc. No private securities transactions were sold through cfd Investments, Inc. to the complainants. Dana Vietor never advised the firm that he was engaging in private securities transactions, and instead advised the firm that he was not engaging in private securities transactions. The transaction involving the private placement investment allegedly sold to the complainants was outside of the knowledge or control of Ashley Vietor-Bolson. The customers have not raised their concerns to the firm prior to filing the Arbitration.
