• Allegations: Von Lipsey was a subject of the customer’s complaint against his member firm that asserted the following causes of action: violation of the Virginia Securities Act, common law fraud; securities fraud; breach of fiduciary duty; unsuitable recommendations; negligence; negligent supervision; breach of contract; control person liability; and respondeat superior.

• Broker Comment: I deny any allegation of improper conduct and made no misrepresentation of the client of the risks and opportunities associated with the Yield Enhancement strategy as disclosed to me by the 3rd party investment managers engaged on behalf of my client. I fully informed my client as to all the investments at issue and discussed the risks and suitability of the investments with my client. The amount of the investment was based upon the stated strategy minima, my understanding of the client’s income needs and risk tolerance, and the expected volatility of the markets as experienced over the prior decades of published results. I further believe that the claim is factually incorrect in a number of areas and that my client was treated with fairness and thoughtfulness, that the administration of the clients’ accounts was handled properly, and that I acted in my client’s best interests at all times. Further, the losses experienced in the Yield Enhancement Strategy were unprecedented and beyond any possible outcome scenario presented by the investment managers.

July 2020 Customer Dispute

• Allegations: Time frame: Starting in September 2017 Claimant’s counsel alleges unsuitability and misrepresentation with respect to recommendations to invest in and hold an options overlay strategy. Claimant’s counsel further alleges unsuitability of certain investments, and that such investments resulted in principal losses.
• Damage Amount Requested: $1,700,000.00
• Broker Comment: I  deny any allegation of improper conduct and made no misrepresentation of the client of the risks and opportunities associated with the Master Limited Partnership (MLP) and Yield Enhancement strategies as disclosed to me by the 3rd party investment managers engaged on behalf of my client. I fully informed my client as to all the investments at issue and discussed the risks and suitability of the investments with my client. The amounts of the investments were based upon the stated strategy minima, my understanding of the client’s income needs and risk tolerance, and the expected volatility of the markets as experienced over the prior decades of published results.
