Investors who entrusted their accounts to Joseph Kelly, formerly of Spartan Capital Securities, should closely review their trading histories.

BrokerCheck records reveal that Kelly has been the subject of multiple customer disputes totaling approximately $2.49 million in alleged damages. In late 2025, FINRA sanctioned Kelly for a pattern of excessive and unsuitable trading. FINRA found that Kelly’s trading generated $365,344 in commissions while causing $262,683 in realized losses for his customers.

According to FINRA, Kelly exercised de facto control over certain retail accounts. By frequently trading in and out of positions, a broker can generate massive commission fees that drain an investor’s principal, regardless of market performance. FINRA found that Kelly willfully violated Regulation Best Interest and FINRA’s suitability rules. He was suspended for nine months and ordered to pay restitution.

Excessive trading, or churning, is a serious violation. If your account was handled by Joseph Kelly or Spartan Capital and you suffered substantial losses while paying high fees and commissions, you have the right to investigate.
