Former broker Christopher Fulco has been barred by FINRA and charged by the SEC with swindling investors out of at least $1.6 million and using the funds for personal vacations, gambling, and child support payments.

The SEC filed a complaint on September 18, 2019 against Christopher Fulco and JM Capital Holdings, LLC (JM Capital). The complaint alleges that over a 3 year period from April 2016 to April 2019, Mr. Fulco — on behalf of JM Capital — engaged in an offering fraud, stealing nearly $1.6 million from at least 10 investors. Most of the investors were elderly retirees.
Mr. Fulco, who had been previously barred by FINRA in 2014, used aliases to conceal his true identity — such as, Christian Anthony, Johnathan Stewart, and Michael Barron. Through JM Capital, Mr. Fulco cold-called investors and solicited investments for a private electric vehicle company, a medical device company, a fund he stated that he managed, and a promissory note. Contrary to Mr. Fulco’s statements to investors, he used the funds to cushion his luxury lifestyle. He spent significant portions on vacations, gambling, mortgage payments, child support payments, and luxury goods.
In 2014, Mr. Fulco was barred by FINRA for allegedly participating in private securities transactions without providing written notice to his firm, falsely testifying in FINRA testimony, and encouraging a witness not to appear or to provide false testimony to FINRA staff.
The SEC is seeking permanent injunctions, disgorgement of ill-gotten gains, prejudgment interest, and civil monetary penalties against Mr. Fulco and JM Capital.
